These Terms of Use apply to the Tesoro application for iPhone. They are an agreement between you and Daniel Olivan Parrilla, trading as getTesoro.app, of Western Australia, Australia.
They are not an agreement with Apple. Apple distributes the app and processes payment, but is not responsible for the app or its content. By downloading or using Tesoro you agree to these terms. If you do not agree, do not use the app.
You must be at least 18 to subscribe, because a subscription is a contract.
Tesoro is a personal record-keeping and calculation tool. You enter your own financial information and Tesoro organises it, summarises it and projects it forward.
Tesoro does not connect to any bank, lender or financial institution. It has no access to your accounts and cannot verify anything you enter. It is a tool for personal organisation only.
Tesoro does not provide financial, credit, investment, tax or legal advice, and nothing it displays is a recommendation to enter into, vary or exit any financial product or credit contract.
Tesoro does not take your objectives, financial situation or needs into account. Before acting on anything you see in the app, consider whether it is appropriate for you and seek advice from a licensed financial adviser, mortgage broker, accountant or other qualified professional.
Tesoro does not advertise, promote, compare or recommend any specific lender, loan, or financial product.
Every figure Tesoro produces is calculated from information you enter and from assumptions you control. Balances, totals, averages and forward projections are estimates, not predictions or guarantees.
Projections of repeating transactions assume those transactions continue exactly as you have described them. Account balances reflect what you have recorded, not what your bank holds. Where Tesoro projects any interest-bearing arrangement, the result will differ from the provider's own systems, which apply their own day-count and rounding conventions, their own timing for when payments clear, and fees that may not be reflected in what you entered.
Your bank's or lender's figures are the authoritative ones. Always verify against your statements before making a decision.
Your records are stored on your own device and, if you enable sync, in your own iCloud account. We have no copy of them and cannot recover them for you. Keeping backups is your responsibility, and the app's CSV export exists so you can do that.
Tesoro cannot verify anything you enter. If the inputs are wrong, the outputs will be wrong. You are responsible for the accuracy of the data you record.
An exported CSV file is plain text and is not encrypted. Once you export it, protecting it is your responsibility.

Tesoro offers optional paid features by subscription and by one-off purchase. All purchases are made through the Apple App Store. Apple is the merchant. We do not process payments, store payment details, or see who has purchased.
Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can view, change or cancel a subscription at any time in your Apple Account settings, and cancelling there is the only method that takes effect.
Refunds are handled by Apple under Apple's own policies and under any statutory rights you have. We cannot issue refunds ourselves, but if something has gone wrong, please contact us and we will help where we can.
If a subscription lapses, your data remains on your device. We never delete your records.
Your licence to use Tesoro is granted under Apple's Licensed Application End User Licence Agreement (the “Standard EULA”), which applies to apps distributed through the App Store. In summary, you may install and use Tesoro on any Apple device you own or control, as permitted by Apple's Usage Rules, and you may not redistribute, resell or reverse-engineer it.

You must not use Tesoro:
The Tesoro name, logo, design, graphics and code are our property and are protected by intellectual property law. Nothing in these terms grants you any right to use them.
You own and retain ownership of everything you record in the app. We claim no rights over your data, and could not exercise any if we did, since we never receive it.
Apple, iPhone, Apple Pay, Face ID, Touch ID, iCloud and Shortcuts are trademarks of Apple Inc. Any other product or company names mentioned belong to their respective owners and are used for identification only.
We may modify, suspend or discontinue features at any time. Updates may add, change or remove functionality. If a material change to the permissions the app requires is needed, iOS will ask for your agreement at that time.
We may update these terms. Changes take effect when posted here, and the date at the top will be updated. Continued use of the app after a change means you accept the updated terms.
Certain legislation gives you rights, guarantees and remedies that cannot be excluded, restricted or modified by agreement. Nothing in these terms excludes, restricts or modifies those rights.
This includes, without limiting anything else that may apply to you, the Australian Consumer Law in Schedule 2 of the Competition and Consumer Act 2010 (Cth); the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 in New Zealand; the Consumer Rights Act 2015 in the United Kingdom; and the consumer protection rights available to you under Spanish and European Union law, including the General Law for the Defence of Consumers and Users.
Everything below is subject to that. Where you have statutory rights, they apply regardless of anything stated here.
Subject to section 11, and to the maximum extent permitted by law, the app is provided “as is” without warranties of any kind, and we are not liable for any indirect, incidental, special or consequential loss arising from your use of, or inability to use, the app, including loss of data, loss of profits or business interruption.
We do not warrant that the app will be uninterrupted or free from error.
Subject to section 11, our total liability for any claim or series of related claims is limited in aggregate to the amount you paid us for the app in the twelve months before the event giving rise to the claim.
If any provision of these terms is found unenforceable, that provision is severed and the rest remain in effect. Any provision which by its nature should survive termination will do so, including sections 3, 4, 9, 11 and 12.
Our failure to enforce any right or provision is not a waiver of it.
These terms are governed by the laws of Western Australia, Australia. You and we submit to the exclusive jurisdiction of the courts of Western Australia for any dispute concerning these terms, without limiting any right you have to bring a claim in your own country of residence where the law gives you that right.
